1. Acceptance of Terms
By accessing or using Sportee ("Sporteemart.com," "the platform," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Description of Service
Sportee is a peer-to-peer marketplace that connects sports equipment owners with renters. We provide the platform for users to list gear, communicate, arrange rentals, and process payments. Sportee is not a party to any rental agreement between users — we act solely as an intermediary.
3. Eligibility
You must be at least 18 years old to create an account and use Sportee. By registering, you represent that you are of legal age and have the authority to enter into these terms.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate and complete information when creating your account.
- We reserve the right to suspend or terminate accounts that violate these terms.
5. Listing Gear (Owners)
As a gear owner, you agree to:
- Provide accurate descriptions, photos, and condition ratings for your equipment.
- Only list gear that you own or have the right to rent out.
- Ensure listed equipment is safe, functional, and in the described condition.
- Respond to rental requests in a timely manner (approve or decline).
- Honor approved bookings and make gear available during the agreed rental dates.
- Set fair and transparent pricing for your gear.
6. Renting Gear (Renters)
As a renter, you agree to:
- Use rented equipment responsibly and for its intended purpose.
- Return gear on time and in the same condition as received (normal wear excepted).
- Communicate any damage or issues to the owner promptly.
- Not sublease or allow unauthorized third parties to use the rented gear.
- Complete payment through the Sportee platform — do not arrange off-platform payments.
7. Booking & Payment
- Rentals follow a request-based flow: the renter submits a request, the owner approves or declines, and payment is processed only after approval.
- All payments are processed securely through Stripe. Sportee does not store credit card information.
- A platform service fee of 30% is deducted from each rental. The remaining 70% is paid to the gear owner.
- Owners receive payouts through Stripe Connect. Owners must complete Stripe onboarding to receive funds.
- Prices are listed in Canadian Dollars (CAD) unless otherwise specified.
8. Cancellations & Refunds
- Renters may cancel a pending or approved request at any time before payment is made at no cost.
- Either party (renter or owner) may cancel a confirmed (paid) booking up to 48 hours before the rental start date and receive a full refund of the rental amount and any security deposit. Refunds are processed automatically via Stripe and typically arrive within 5–10 business days.
- Cancellations made within 48 hours of the rental start date are not eligible for a refund.
- We encourage owners and renters to communicate directly through the platform chat to resolve scheduling issues before cancelling.
9. Assumption of Risk
Sports and outdoor activities involve inherent risks, including but not limited to the risk of serious bodily injury, disability, and death. By using equipment rented through Sportee, you acknowledge and voluntarily assume all risks associated with the use of such equipment and participation in related activities.
10. Liability & Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Sportee acts solely as a marketplace and is not a party to any rental agreement between users. Sportee does not own, inspect, certify, or control any equipment listed on the platform.
- Neither Sportee nor the renter shall be liable for any personal injury, bodily harm, disability, or death arising from or related to the use, misuse, or malfunction of rented equipment, regardless of cause.
- Neither Sportee nor the renter shall be liable for any loss, damage, or claim arising from defective, faulty, worn, or improperly maintained equipment listed on the platform. Gear owners are solely responsible for ensuring their equipment is safe, functional, and accurately described.
- Sportee is not liable for any injury, loss, property damage, or consequential damages arising from the misuse of equipment, use of equipment beyond its intended purpose, failure to follow manufacturer instructions, or use of equipment by unqualified or untrained individuals.
- Users rent and use equipment entirely at their own risk. Renters are responsible for inspecting all gear before use and determining whether it is safe and suitable for their intended activity and skill level.
- Sportee makes no warranties or representations regarding the fitness, safety, quality, or condition of any equipment listed on the platform. The platform and all services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- In no event shall Sportee's total liability to any user exceed the amount of platform fees paid by that user in the twelve (12) months preceding the claim.
- We strongly recommend that both owners and renters carry appropriate personal liability and property insurance, especially for high-value or high-risk equipment and activities.
11. Indemnification
You agree to indemnify, defend, and hold harmless Sportee, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the platform, your use of rented equipment, your violation of these Terms, or your violation of any rights of another party.
12. Prohibited Conduct
You agree not to:
- List stolen, counterfeit, or illegal equipment.
- Provide false or misleading information in listings or profiles.
- Harass, threaten, or abuse other users.
- Circumvent the platform to avoid service fees.
- Use the platform for any unlawful purpose.
- Attempt to interfere with or compromise the platform's security or functionality.
13. Intellectual Property
All content on Sportee — including logos, text, design, and software — is owned by Sportee or its licensors and is protected by applicable intellectual property laws. Users retain ownership of content they upload (photos, descriptions) but grant Sportee a non-exclusive license to display it on the platform.
14. Dispute Resolution
We encourage users to resolve disputes directly through the platform chat. If a resolution cannot be reached, you may contact us at [email protected] for mediation assistance. Sportee reserves the right to make final decisions on disputes at its discretion.
15. Termination
We may suspend or terminate your account at any time for violating these terms, engaging in fraudulent activity, or for any other reason at our sole discretion. Upon termination, your right to use the platform ceases immediately.
16. Changes to Terms
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the platform after changes constitutes acceptance of the revised terms.
17. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to conflict of law principles.
